IIPM, a Management Institute run by Mr Arindham Chaudhary has slapped legal notice claiming Rs 125 crores as damages including threat of arrest on a Mumbai Blogger Mr. Gaurav Sabnis in relation to some defamatory posts made by later on his blog at http://gauravsabnis.blogspot.com.
Also the blogger’s employer IBM was threatened by IIPM that in case the posts were not deleted, the IBM ThinkPad Laptops will be burnt in front of IBM office, which lead to his resignation, though he was never pressurized by his employers. Though Mr Gaurav maintains his stand and talks about his right to freedom of speech…. which is really commendable.
Another notice of Rs 175 crores has also been served on one otherBlogger from Delhi, which later on has been denied by IIPM on her blog.

Legal Point of View….
The notice through email has been recognized by Law. Though some feel, it is better to send legal notice additionally through registered post. But ofcourse threatening legal notice can be sent through email without any intention to proceed with the Legal action.
And two things definitely point to the fact, the notices are sent with the intention of Threatening only… which to some extent is clear from the harsh language used:
1. If the Institute intends to claim 300 crores (125 crore and 175 crores) from two Bloggers in the court of law. Let them first made the calculations of the court fees/stamp duty they will be required to be paid 😛
2. There is no defamation, if the things are proved to be true ❓
Then the kind of Legal Notice drafted has been criticized by Lawyer’s Community. As there is nothing like “judicially notarized” exists at the stage of legal notice.
What comments lawyer made… in Discussion Groups:
“It is just a way to intimidate critics with big but empty legal threats”
“What you have here is a so-called management institute that doesnt seem to understand the concept of judicial notarization”
“The so called legal notice is bullshit and very badly drafted.”
“The concept & term ‘judicially notarized’ is not clear and the legal notice does not necessitates the use of such notorisation.”

the intention of Threatening could be because those people i am not sure if they have recieved the copy.. i mean actully got sued
even while writing my article i had to cross check twice :-p :attack: getting sued wasnt in my priority list thus made sure to check the facts two times…
