    Hi Ankur,

    Congratulations on winning this totally landmark case in a court of law. It will be a good idea if you could put up the details of how you went about proving the deficiency in service, that is the documents required, what one needs to take into account and other nitty gritties!

    congrats on winning case against sify.
    i am totally happy.

    hey man, i am also a sify broad band customer,i am facing problem, our cable TV operator, is not providing the service properly, ie he switches of the server during lightening, says that devices will get damaged. I was not aware of this problem at the time of instalation. i asked for my repayment of my installation charges, & he refused to give back, he was to harsh on me.

    i have complained requarding this issue to the sify customer care and have lodged 12 complaints, no one is yet trying to resolve it.

    can u guide me what can i do for this.
    i am ready to do anything against sify.

    Hi Ankur,

    While searching Net for SIFY Broadband, I came to know that you have won a service fraud case against SIFY (Satyam Infoway)
    Limited for deficiency in their Broadband services.

    Congrats to you for showing remarkable courage and fight. Being a lawyer, it must have been some what easy for you to fight
    this deserved battle against a truly Fraud Co. which is still continuing to do so.

    While the normal people (unfamiliar with the painful Indian legal system) who have taken SIFY broadband because of no other
    alternatives are still getting cheated. My statement has come from the research done by me on SIFY Broadband and me too
    being their customer. What I am trying to ask is – Instead of fighting individual cases against a big but highly unprofessional and cheater Co.
    whose top bosses comes for sleeping in offices, Is there a way this Co. can be legally closed because of massive deficiency
    in their services (not delivering the services to the Customer for which they got the money for)? I know that I will have to manage with dialup connection if SIFY closes, but I really want to teach this cheater Co. a good lesson as they have and are still wasting my time, energy and money in getting service from them. If I start writing how SIFY is wasting my time and resources, then there will hardly be any space left at your hosting account :).

    Also, I don’t agree with the pennies (Rs. 8200) that the court have awarded you for your two year battle which must have been full of mental pressure and frustration due to lengthy and time wasting legal formalities. The court must have given you Rs. 10 lakh as your work suffered because of the poor broadband service plus fighting the very long two years legal battle in an Indian court. If all the proofs and documents available with you were Okay, then why did the court took 2 years to give its declaration? Its really disgusting that the Indian legal system is painfully slow to deliver the justice even if things are very clear. Also, Rs. 10 lakh would have been a good amount to teach SIFY a good lesson to improve their
    services as they would have got scared that other similar customers who are still getting cheated can also file cases and win against them. Do you agree with me? Rs. 8200 is a very small amount to discourage SIFY from doing the cheating in their services as done in your case. Had it been a case in US, the Co. would have to shell a lot of dollars, why not in India?

    I again admit that you have done a remarkable job in fighting against a Co. that sadly hasn’t learn anything even after loosing the case for cheating in their Broadband services. Kudos to you. I am sure that winning this case would also have made you famous and thus you must be getting more cyber cases, worth fighting.

    The thing was I had demanded Rs 5,000 as compensation only…. so it was only granted… because at the time I filed the complaint, it did not seem to be such a bug issue and I had used Internet for 2 months only… so had demanded reasonable compensation only…

    Though surely, Court should have ordered atleast few Lakhs to be paid to the State Consumer Fund too.

    As regards getting SIFY shut down… it is only possilbe, if thousands of Consumer unite and make representation to TRAI… but die to busy schedule only few will show interest… i am sure.

    As even I had asked others to join in and even claim compensation separately… but it could not happen…

    Further as regrds, two years time frame… it was because District Forum had in the first instance dismissed the matter, so I had to move State Commission in appeal, whereby the matter was sent back to District Forum and started afresh and finally decided in my favor…
