US Laws…

3/19/2005 By Blogger 5 Comments

Now after Mr Modi’s visa was rejected by US, the BJP says it’s an insult to our Constitution. But they didn’t back me up, when my tourist VISA was rejected 😉

Really, I had the same words that US Law is an Insult to an Indian Citizen…

The US law provide unless you show strong ties to India, when applying for a non-immigrant VISA, you will be assumed as an Immigrant. This is an unnecessary allegation, as when the consulate issues a VISA only for six months. How they can assume, the tourist will over-stay ❓

Basically, I think there can be only two ways to stay back in USA…

Firstly, either illegally… which I don’t think an ordinary person will try to do. But even in rare of the case, some one stays back, it is their duty to keep vigil and deport the concerned person. Or to provide with harsh punishments, so that no one even thinks of staying back illegally

And when they are themselves offering Green-Card to all the illegally immigrant staying in USA for 5 years or more, then who is the culprit 😕

This happened last year, it was announced that every one staying in USA for more than 5 years, whether legally or illegally will be granted a Green Card  In this way, they are themselves inspiring people to stay back and wait until they are granted a Green Card, which is a kind of Bravery award as they had guts to stay back illegally, so got a Reward 😀

Secondly, a person may stay back, if he joins some job or takes admission to the University. Then in this case also it is USA only, who allows converson of VISA. i.e. it’s their wish …. nothing is thrust upon them. And they are impressed that an Indian has such good qualifications or other merits… which will be beneficial to their country, that’s why other kind of VISA is granted. They also know very well that an American cannot achieve or do what an Indian can ❗

Then why…. why axe falls on an innocent tourist 😕

Ankur…I agree that US Laws are really not in track. They do not have a well defined system. They are trying to be cautious (especially after 9/11), but I agree, they don’t have any set rules that they follow. Many people are still entering this country illegally…and there are many who want to come here just for a visit, and are still not allowed. There has to be a better way!
People do come to US and end up staying here without proper authorization. I think the whole system is so spread out, that USCIS has been having tough time keeping track of everyone. They are trying to centralize everything, which I am sure will help. Now you cannot come here on a tourist visa and get it converted to student visa. They stopped that 2 years back. This has helped a lot. Earlier it was really easy to come here and get an F1 (student visa). Another option that tourists have is to get an H1 (work visa). That is also real hard to get. 1 in 100 would get that. So the only way tourists end up staying here is illegally.
The other thing about issuing GC’s to every person who has been in US for more than 5 years is not correct. I do remember something like this happening couple of years back, but it was really limited (had many guidelines)…so hardly anyone came under that (I have been in US for more than 7 yrs!). The US Govt. basically did that to have the illegal immigrants come forward and become legal (so that the govt. could collect taxes from them). It was done more to stop tax evasions by the illegal immigrants than to really give them the GC’s.
I do understand that people in India get frustrated over this. Many like you have a genuine reason to come to US for a visit, but are not able to. Somewhere down the road, I think, there would be a better way issuing tourists visas…but when…that’s the big question:?:

i have never understood how some ppl get a visa and others who genuinely have a good reason to come..don’t get it. Not fair @ all. Its those ppl who have made it here illegally that have caused the bad rap…now you put yourself in the hands of the us embassy whether you are going to get a visa and that’s just wrong. My cousin had gotten into Sycruse University..had all the papers from the uni..we even sponsored him..but when he went to the embassy in Mumbai..they rejected him WITHOUT even looking @ his papers. Galat.. bilkul galat.

Bhabhi:!: but this kind of issuance of VISA surely happened last year and was in news here.

In any case, it is US Govt duty to take care no one stays back. But seems they are not able to implement any such measure, for which others have to suffer 😉

Ya Poonam:!: they reject VISA on improper grounds. To reject a Student’s VISA is worse than rejection of Tourist VISA.

Do one thing, fix up a meeting with Mr Bush, we will discuss the matter in detail with him 😉
