SIFY Decision Analysis…

12/6/2005 By Blogger 1 Comment

In SIFY Decision, in addition to this point “we have no jurisdiction to entertain the matter and I should approach TRAI”. Court also had said expert evidence is missing in this case…

But TRAI chairman Mr Pradeep Baijal said: “Consumer complaints are not in the purview of the Trai Act. A district consumer forum looks after such complaints….. (Already reported before) http://www.telegraphindia.com/1050707/asp/business/story_4959104.asp

Reg the second point… i.e. it was also mentioned in the judgement at the end –> expert evidence is missing in the case… whose reply lies in National Commission decision in the case of :

“M/S Scooter India Limited & Anr V. Madhabananda Mohanty & Ors.” :thumb:

–> “It is always not necessary for the consumers to give expert testimony, though if he does so it will add weight to the complaint.”

My legal research at Delhi High Court Library is proving helpful 😉
